REGULATIONS OF THE EQAC

 

These regulations are established to ensure the integrity of the Education Quality Accreditation Commission and all the services provided. These regulations are meant to be effective and their interpretation is based on the assumption of ethical values, integrity and a non profit spirit from each of the members of the Education Quality Accreditation Commission.

 

These premises may evolve to address new situations or services upon proposal from the members of the Education Quality Accreditation Commission. Proposals will be accepted by the President from individuals or groups, including students, staff, faculty, members of the general public, governmental agencies, and other institutions or organizations. The President reviews any proposal and acknowledges its responsibility to provide a reasonable and impartial review. Proposals should be sent to the EQAC Secretary.

 

 

1. Regulations for the Education Quality Accreditation Commission members.

 

1.1. Definition of the Commission (EQAC).

The Education Quality Accreditation Commission is formed by a minimum of 5 members, including the Secretary and the President. Commission members work on a voluntary basis on a year-by-year compromise. They are responsible for evaluating and recommending the Education Quality Accreditation status of applicant higher education institutions and supervising any other validation services offered. The Education Quality Accreditation Commission is represented by the EQAC President or Secretary when dealing with other commission members, education institutions or any other third party. In case of discrepancy with the President of the EQAC or the Secretary, an arbitrage of 3 Commission members will be established: one selected by the President (or himself), one by the conflicted commissioner (or himself), and one agreed by the President and the conflicted commissioner before the nature of the conflict is exposed. The conclusion of these 3 members' arbitrage will be accepted by all the parties.

 

1.2. Commission member selection.

Joining the Education Quality Accreditation Commission as a Commission Member is open to any person holding a postgraduate level degree, and must contribute to the mission and improvement of EQAC with work, networking or other contributions. The candidate member must be recommended by any other Education Quality Accreditation Commission member, accredited institution or body from the EQAC Selection. The candidate may also self-propose to become a member of the commission. Self-proposed candidates will be accepted if endorsed by any EQAC member, accredited institution or selected body. The candidate's detailed Curriculum Vitae must be sent to the EQAC Secretary. Final EQAC membership must be approved by the EQAC president. Membership will be granted for three years and will be automatically renewed for one-year periods until revoked by either party.

 

1.3. Commission member integrity.

All the Education Quality Accreditation Commission members will be impartial and objective in considering the eligibility for accreditation of educational institutions or any other assigned duty. Integrity should not be affected by conflict of interest or personal gain. Whenever there is an apparent conflict of interest, another member of the commission will take on the resolution of the assigned duty. The Education Quality Accreditation Commission expects any commissioner with a conflict of interest to dismiss himself or herself from the assigned duties. The president of the EQAC may propose the expulsion of any member with sufficient apparent conflict of interest. The expulsion proposal will be announced to all the members of the Commission and will take effect 10 days after the announcement, unless there is an expressed majority opposing to the expulsion.

 

1.4. Commission member obligations.
1.4.1. Voluntary involvement & benefits.

Education Quality Accreditation Commission members work on voluntary basis. Each commissioner decides the level of involvement with the Education Quality Accreditation Commission and the benefits derived from this involvement. Your position at the EQAC is compatible with any other positions in academic institutions or professional activities provided the fact that such activities or positions are not in direct competition with the interests and goals of the Education Quality Accreditation Commission. Commission Members may execute their duties from anywhere in the world.

1.4.2. Your name on the EQAC Website.

Education Quality Accreditation Commission members names and educational background will be publicly displayed by the EQAC website. The EQAC will not disclose any personal or contact data without your expressed consent. When you are accepted in the commission your name will be listed for a minimum period of three years. This period will be automatically renovated until any of the parties decides to cancel the agreement. Any cancellation notice must be sent in writing by letter or email to the EQAC Secretary.

1.4.3. Promotion of the EQAC Services.

The Education Quality Accreditation Commission expects that every member of the commission will contact different educational institutions which may profit from accreditation and that may meet EQAC standards as well. Every institution applying for accreditation as a result from your promotional actions will report a commission fee.

1.4.4. Evaluation of the Accreditation Status.

Education Quality Accreditation Commission members are in charge of the evaluation of educational institutions. Evaluation and other duties are assigned by the EQAC Secretary according to the commissioners' availability, the educational institution preference and these regulations. The assigned commissioner will evaluate and grade the applicant educational institutions according to EQAC standards and reflect the grades, conclusions and comments on an Accreditation Evaluation Form (AEF). The EQAC Secretary will make available to the evaluating commissioner the necessary documentation about the applicant educational institution. The commissioner will be paid the corresponding fee once the AEF has been returned to the EQAC Secretary or the assigned duty has been accomplished. Any commissioner, at its own discretion, may supervise that EQAC standards and regulations are met by any accredited institutions. 

Education Quality Accreditation Commission members may evaluate and contribute to the eligibility for accreditation of applicant educational institutions. The evaluation is conducted on one single page form that may be downloaded from the EQAC Web page. This form is called ACCREDITATION EVALUATION FORM (AEF). The EQAC Secretary will always ask your availability before assigning any applicant to you for evaluation. The AEF should be scanned and email back to the EQAC Secretary duly graded, dated & signed. Once the AEF is received by the EQAC Secretary you will receive the payment of a 20% of the accreditation fee.

 

1.5. The Education Quality Accreditation Commission Secretary.

The Education Quality Accreditation Commission Secretary is appointed by the President of the EQAC for a minimum period of three years. The person acting as the EQAC Secretary must be a member of the Commission, and must present a voluntary candidacy to the President of the EQAC to be eligible. The proposal will be announced to all the members of the Commission and will take effect 10 days after the announcement unless there is an expressed majority opposing to the nomination. The EQAC Secretary is responsible for considering the eligibility of applicant institutions, the suitability and language of the self study report and attached documents, and it will establish the time, place, and procedures for the actions of the Commission. The Secretary is in charge of collecting fees, maintenance expenses and payments for the services rendered by the commissioners. The EQAC Secretary must sign and endorse any recognition granted from the president of the EQAC, after ensuring that all EQAC regulations are met. The EQAC Secretary is responsible for all the administrative work derived from the EQAC validation services. In case of discrepancy with the President of the EQAC, an arbitrage of 3 Commission members will be established: one selected by the President (or himself), one by the Secretary (or himself), and one agreed by the President and the Secretary before the nature of the conflict is exposed. The conclusion of these 3 members' arbitrage will be accepted by all the parties.

 

1.6. The Education Quality Accreditation Commission Selection.

The EQAC Selection is a set of bodies whose certification or membership the President of the EQAC considers similar or equivalent to the EQAC accreditation. The EQAC Selection must be endorsed by the EQAC Secretary. Member institutions from any of the EQAC selected bodies may automatically qualify for the EQAC accreditation. The EQAC Selection bodies may also propose their own members to become part of the EQAC.

 

1.7. The Education Quality Accreditation Commission President.

The President of EQAC must be a member of the Commission, will be appointed by simple majority of the votes of the Commission and it is granted for a period of five years. Commission members may only vote those candidates who have presented a voluntary candidacy and have been approved by the President and the Secretary. The President of EQAC will have the power to supervise the action of the other members, to intervene in case of conflict or lack of integrity, to propose the acceptance or expulsion of other members, to appoint the EQAC Secretary and to select recognition and membership from other bodies that may be deemed equivalent to the EQAC accreditation. The EQAC President has the authority to grant with his signature the accreditation of educational institutions. Actual status must be endorsed by the EQAC Secretary.

 

1.8. The EQAC operational proposal, change of regulations and service fees.

The Education Quality Accreditation Commission is set as a non profit organization. Based on this premise, any proposal as well as the fees established for the accreditation of education institutions or any other validation services provided by the Education Quality Accreditation Commission, must be submited to the President. Upon evaluation of the proposal and/or fees by the president, the conclusions must be endorsed by the EQAC Secretary and will be presented for approval to the other members of the Commission. The proposal will be announced to all the members of the Commission and will take effect 10 days after the announcement, unless there is an expressed majority opposing to the proposal. The proposal may include the modification of the EQAC regulations. Fees and Regulations will be revised every 3 years with the appointment of the new EQAC Secretary.

 

1.9. The Education Quality Accreditation Commission Monetary Distribution.

The gross income derived from the accreditation and services rendered by the EQAC will be distributed according to the following percentages. Distribution of the fees is due as soon as the income is collected:

1.9.1. Accreditation fees distribution:
  • 20% for the Commissioner in charge of the evaluation of the accreditation of an education institution.
  • 10% for the Secretary in charge of the administrative process, coordination and paperwork.
  • 10% for the President in charge of the supervision and endorsement of the accreditation status.
  • 10% commercial fee for recommending the contracted EQAC services to the referer.
  • 20% for the EQAC Institutional Guarantee Fund to ensure the continuity and durability of the EQAC.
  • 30% for the EQAC Operational Fund to pay for the required expenses and maintenance.
1.9.2. Validation services fees distribution:
  • 20% commercial fee for recommending any contracted EQAC validation services.
  • 10% for the President in charge of the supervision and endorsement of the required service.
  • 10% for the Secretary in charge of the administrative process, coordination and paperwork.
  • 30% for the EQAC Operational Fund to pay for the required expenses and maintenance.
  • 30% for the EQAC Institutional Guarantee Fund to ensure the continuity and durability of the EQAC.
1.9.3. The EQAC Operational Fund.

This fund is used by the EQAC to promote and enhance its presence through the Internet, to pay the expenses and memberships that may foster the EQAC missions, to pay the maintenance of the administrative costs required for its operational development and the services rendered, to add new free courses to its database, and to enhance the overall quality of the services offered and the institution. Use of this fund must be authorized by both, the President and the Secretary of the EQAC. Annual financial reports will be presented to all Commission members upon request.

1.9.4. The EQAC Institutional Guarantee Fund.

This fund is used by the EQAC to ensure the EQAC's durability. It takes care of structural maintenance fees and it is considered a reserve to ensure the duration of minimum administrative services for a period of five years. Use of this fund must be authorized by both, the President and the Secretary of the EQAC. Annual financial reports will be presented to all Commission members upon request.
